These General Terms and Conditions of the (Bokeh-Fashion) organization (hereinafter referred to as “the platform”) apply to all orders placed by the consumer with the platform and will come into effect on 31st December 2023.
In these Terms and Conditions, the product manufacturer is referred to as the “vendor”.

By using the platform and / or placing an order, the consumer agrees to be bound by the Terms and Conditions set out herein. The consumer should make sure to read and understand the Terms and Conditions before placing an order.
We reserve the right to amend these Terms and Conditions from time to time without prior notice. The version of the Terms and Conditions that will apply to an order will be those on the platform at the time of order placement.
The inclusion of any products on the platform at a particular time does not guarantee or warrant that these products will be available at any time. The platform reserves the right to discontinue any product at any time.
Each consumer may only have one account with the platform. We reserve the right to delete multiple registrations of one person.
The consumer has the right to request his data (account information including contact information, order history, wish list and a summary of when and how he contacted us) or can request to delete his account by contacting customer service.

These Terms and Conditions apply to every offer made by the platform and to every distance contract concluded between the platform and the consumer.
Before any distance contract is concluded, it will be indicated that these Terms and Conditions can be viewed and inspected online by the consumer by clicking a link on the check-out page.
In the event that specific product or service conditions apply in addition to these general Terms and Conditions, should conflicting conditions exist, the consumer can always invoke the applicable provision that is most favorable to him.
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products, digital content and / or services being offered which is sufficiently detailed so as to enable the consumer to make a proper assessment of the offer. Any images used by the platform are a true representation of the products, services and/or digital content offered. Obvious mistakes or errors in the offer are not binding for the platform.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. In particular this includes:
Jordanian law is applicable to all our agreements.
Subject to the provisions of paragraph 4, the agreement is concluded at the time of acceptance by the consumer of the offer and compliance with the corresponding conditions.
If the consumer has accepted the offer electronically, the platform will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the platform, the consumer can dissolve the agreement.
If the agreement is concluded electronically, the platform will take appropriate technical and organizational measures to secure the electronic transfer of data and he will ensure a safe web environment.
Within statutory frameworks, the platform can inform itself whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, the platform has good reasons not to enter into the agreement, it is entitled to refuse an order or request, with reasons, or to attach special conditions to the execution.
At the latest upon delivery of the product, service or digital content to the consumer, the platform will send the following information, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:
a) the visiting address of the business location of the platform where the consumer can go with complaints
b) the price, including all taxes on the product, service or digital content; insofar as applicable, the costs of delivery; and the method of payment, delivery or implementation of the distance contract
By clicking the button “Place order” you place a binding order with regard to the items in your shopping cart. We will confirm receipt of your order by e-mail immediately after sending your order. A binding purchase agreement is concluded upon receipt of the order confirmation.
You agree to the assignment of the vendor’s claims for payment of the purchase price to third parties, in particular to the platform.
Agreements via Bokeh-Fashion.com are concluded in either English or Arabic. When ordering Bokeh-Fashion items, the contracting party is the vendor that manufactures the items. Information about the identity of the vendor can be found linked on the respective article page. The vendor concerned is not affiliated with the platform. However, any claims or disputes should be addressed directly to the Platform as facilitator.
The prices stated in the offer at the time of the order apply. The indicated prices are final prices. This means that they include the applicable statutory Sales Tax applicable at that time. Until the full purchase price has been paid, the products remain the property of the relevant vendor.
During the period of validity mentioned in the offer, the prices of the products and / or services being offered will not be increased, except for price changes as a result of changes in rates of sales tax.
Contrary to the previous paragraph, the platform can offer products or services whose prices are subject to fluctuations in the financial market and over which the platform has no influence, at variable prices.
The shipping costs for orders are shown on the order summary prior to order confirmation and are for the consumer’s account.
The platform guarantees that the products and / or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and / or usability and the legal provisions existing on the date of the conclusion of the agreement and / or government regulations. If agreed, the platform also guarantees that the product is suitable for other than normal use.
Any extra guarantee provided by the platform or vendor (beyond his legal obligation) does not affect the legal rights and claims that the consumer can assert against the platform under the contract if the platform has failed to fulfill his part of the agreement.
If goods that a consumer has purchased contain defects such as an obvious material or manufacturing fault or damage incurred in transit, the consumer should return the goods without delay by following the returns procedure as described in section 14 of these Terms and Conditions. The Platform does not bear any responsibility for defects or defective items.
We make all reasonable efforts to accurately display the attributes of our products, including material composition and colors. The color a consumer will see will depend on the computer system used. We cannot guarantee that the computer will accurately display the colors. The platform does not bear any responsibility for differences in actual products.
A product’s measurements as provided on Bokeh-Fashion.com are approximate values intended to offer a better idea regarding the fit of that product. It is not a guarantee of the actual measurements of the product a consumer receives. Deviations within a reasonable tolerance can occur.
The platform will take the greatest possible care when receiving and implementing orders for products.
The place of delivery is the address that the consumer makes known to the platform.
With due observance of what is stated in article 4 of these Terms and Conditions, the platform will execute accepted orders with due speed and usually within one week but no later than 30 days, unless a different delivery period has been agreed. If the delivery is delayed, or if an order cannot or can only partially be executed, the consumer will be notified of this no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement without costs and is entitled to any compensation.
After dissolution in accordance with the previous paragraph, the platform will immediately repay the amount that the consumer has paid.
Before the consumer places an order, he will be informed of the expected delivery window. Once an order is picked up for delivery, the consumer will receive an email confirmation with the expected delivery details.
If the consumer is consistently not reachable by phone at the contact details provided to the platform within the delivery window advised and after three attempts so that he may take delivery of the order, the distributor will attempt delivery one time to the address provided by the consumer. If the consumer is still not available to take delivery of the order at that time, the goods will be returned to the vendor.
The risk of damage and / or loss of products rests with the platform until the moment of delivery to the consumer or a pre-designated representative made known to the platform, unless explicitly agreed otherwise.
We only deliver within the Hashemite Kingdom of Jordan.
When terms are stated in working days, this refers to all days from Sunday to Thursday, with the exception of legal holidays. Ordering and delivery of Bokeh-Fashion articles is only possible if they are in stock. The website indicates whether the item is still in stock.
Payment is required before or at the time of delivery.
Payment option is Cash on Delivery for the time being.
Complaints about the execution of the agreement must be submitted fully and clearly described to the platform within five days after the consumer has discovered the defects to service-bokeh@gsc.com.jo.
Complaints submitted to the platform will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the platform will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.
The consumer must give the platform four weeks to resolve the complaint in mutual consultation. After this period, a dispute arises that is subject to the dispute resolution.
Contracts between the platform and the consumer to which these Terms and Conditions apply are exclusively governed by Jordanian law.
Disputes between the consumer and the platform about the conclusion or implementation of agreements with regard to products and services to be delivered or delivered by this platform can, with due observance of the provisions below, be submitted to name and address of organization/disputes committee in Jordan.
The responsibility for any product-related issue (such as product quality, fit, and accuracy or legal compliance) and resultant complaint, claim or dispute will be for the individual vendor and not the platform. The consumer should register the complaint with the platform and the platform will work as an intermediary between the consumer and the vendor.

A dispute will only be handled by the organization/disputes committee if the consumer has first submitted his complaint to the platform within a reasonable time.
If the complaint does not lead to a solution, the dispute must be submitted to the organization/disputes committee in writing or in another form to be determined by the organization/disputes committee no later than 12 months after the date on which the consumer submitted the complaint to the platform.
If the consumer wishes to submit a dispute to the organization/disputes committee the platform is bound by this choice. Preferably, the consumer first reports this to the platform.
The Disputes Committee will not deal with a dispute or discontinue the handling if the platform has been granted a moratorium, has become bankrupt or has actually terminated its business activities, before a dispute has been dealt with by the organization/disputes committee at the hearing and a final decision has been made.
Neither the organization nor the vendors that offer products for sale on Bokeh-Fashion.com are responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms and Conditions where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
The maximum liability to the consumer for any loss or damage arising in connection with an order on Bokeh-Fashion.com shall be limited to the total price of the order.
The platform is not responsible for any claims from the consumer relating to inaccuracies, loss, damage, personal injury or delay. This responsibility rests solely with the vendor. The platform will act solely as intermediary for any claim or dispute between consumer and vendor.
Promotional vouchers are vouchers that cannot be purchased, but are issued as part of promotional campaigns and have a limited validity.
Promotion vouchers must be redeemed in the specified period and only once in the context of an order. Some brands, products or vendors may be excluded from the voucher promotion. The promotional vouchers can be linked to a minimum order value.
The value of the goods must at least correspond to the amount of the promotional voucher. A difference with a higher commodity value can be compensated with the payment option offered. The value of the promotional voucher is neither paid out in cash nor reimbursed with an interest rate. The promotional voucher will not be refunded if goods are returned in whole or in part.
Promotional vouchers can only be redeemed before completing the ordering process. It is not possible to redeem it afterwards. The promotional voucher cannot be handed over to third parties. Multiple promotional vouchers cannot be combined with each other, unless we have agreed otherwise.
If a consumer has redeemed a promotional voucher with his purchase, we reserve the right to charge the original price of the goods purchased if – due to a revocation – the total value of the order is less than the respective value of the promotional voucher or it does not meet the conditions.
Returning or exchanging an item is only permissible if the item is defective, or an incorrect item was shipped. Should this occur, the consumer must return the unwanted defective or incorrect item and if the consumer requires a replacement he will be sent the correct item at no extra cost. If the consumer does not require a replacement then he will need to return the item. All items defective or incorrect returned items should be unworn/unused and no labels/tags should have been removed. To return a defective or incorrect item(s), the consumer should fill out the online form, and the platform will be in contact with him to arrange for the return of the defective or incorrect item(s).
The distributor will contact the consumer by phone to arrange pick up of the item(s) from the consumer’s home. Should the distributor be unable to reach the consumer by phone at the contact details provided after three attempts then we will presume that the consumer will have cancelled his request to return the item(s).
In case of returned item(s) and the consumer does not require a replacement, the purchase amount will be returned to the consumer by the platform.
